PRESS RELEASE OCTOBER 14,2004

FOR IMMEDIATE RELEASE:

 Tort claim notice delivered on October 8, 2004 to:

  The City of New York

  The Lower Manhattan Development Corporation

  The New York City Department of Sanitation

  The Port Authority of New York and New Jersey

  The notice states claims arising from the continued and on-going illegal and improper actions and  conduct regarding the transportation, dumping and
  burial of the human remains from the WTC victims that were transported and dumped at the Fresh Kills  Landfill.

  The notice lists nineteen (19) specific claims,  including, to name just a
few  dumping of human remains at a landfill

  failure to properly notify and get consent from next of kin regarding
their wishes for proper  burial

  violations of New York and Federal public health  law, cemetery and burial
regulations,  religions and civil burial laws and environmental laws
governing burial of human remains  infliction of emotional distress to next of kin and  victims' families

 negligent, reckless and intentional co-mingling of the final grade of WTC
contents (which  contains  human remains) with garbage, debris and
waste

 improper and illegal exercise of dominion and control over WTC victims'
human remains

failure to acknowledge and provide for proper burial consistent with
religious convictions and  beliefs of victims' families

violations of NY and US Constitutional freedom of religion, right of privacy
and due process  and liberty interests
